Nettix Oy Terms of Use

 

  1. General

These web services terms of use apply to web services maintained by Nettix Oy (later Service Provider). In these Terms of Use, web services stand for all web services on the internet produced or maintained by Nettix Oy, such as nettiauto.com, nettimoto.com, nettivene.com, nettikaravaani.com, nettivaraosa.com, nettikone.com, nettimokki.com, nettimarkkina.com, and nettivuokraus.com –portals, as well as other services offered online by the Service Provider (later all together or separately Service). These terms apply to all Services maintained by Nettix Oy, unless stated or agreed otherwise. User of the web service (later User) has to accept these Terms of Use bindingly in order to use the Service, whether or not the use of the Service requires registration.

By using the Service, the User accepts this Term of Use, and assures that he/she acts in accordance with these Terms of Use, effective legislation, and good etiquette. Hence, a contract in accordance with this Terms of Use is generated between the Service Provider and the User. The User assures he/she is at least 18 years of age, or that he/she has an consent from his/her guardian to use the Service.

 

  1. Registration

The User joins the Service by registering as a User on related webpages, or in another manner, and by accepting these Service Terms of Use bindingly. A User is each private person, who uses the pages of the Service, or has registered as a Service User. The User has been registered once the Service Provider has verified the registration. Only a natural person may register. It is forbidden to submit incorrect user information, or register by using such, and the User assures he/she has submitted correct information when registering for the Service. Access rights are not transferable. The Service Provider has the right to determine which of the Users of the Service are considered private persons, and which submitted announcements are considered to be private announcements.

The Service Provider has the right to check the User’s credit rating as he/she registers for a paid Service. The Service Provider has the right to prevent the User from using a paid Service, if it is justifiable based on a default arisen when investigating the credit rating, or another acceptable reason.

Due to the Service being an advertisement financed service, communication based on advertising is a prerequisite for continuing the service. Additionally, electronic marketing communications sent to the User are an essential part of the Service. Therefore, the User may be presented with commercial communications and related opportunities, termination of the Service and its renewal, as well as other service products closely related to the Service on the Service website itself and by email, or by other means. When registering, the User has the opportunity to choose whether or not he/she wishes to receive electronic direct marketing.

 

  1. Contents of the Service

The Service Provider aims to produce as high quality Services as possible. The Service Provider is responsible for the editorial content being in accordance with the legislation and good etiquette. The Service Provider develops the Service continuously, and has the right to alter the Service and its contents, as well as the equipment requirements to use the Service as a part of its normal operations. The Service Provider also has the right to terminate producing the Service at any time. This will be announced on the Service webpages in a timely manner before terminating. The Service Provider is not responsible for another Service Provider’s service or its contents, not even in the event of accessing this Service through a link or by other means through the Service Provider. The Service Provider is not responsible for the possible damage caused to the User by using incorrect, insufficient, or ambiguous information in the Service.

The Service may have both free of charge and paid sections. Each Service will state whether it is a free of charge or paid Service. Using paid Services requires the payment announced with the Service to be submitted. Paid Service may be subject to a joining fee, and a fee based on the user activity of the Service, or a time-based fee. The Service Provider may alter the price and pricing formulae of the Service, as well as turn a free of charge Service to paid, and vice versa. Effective prices and pricing formulaes are visible at the webpages of each Service.

The Service Provider is not responsible for the correctness or reliability of the information presented in the Service, or the flawlessness of the products sold and supplied through the Service, or the correctness of information presented about them. The Service Provider is not responsible for the content of opinion- and discussion forums used in the Service. The Service Provider has the right, but not an obligation, to inspect and alter or remove content presented on the forums. Additionally, the Service Provider has the right to alter the headlines of the submitted announcements, and the right to not publish images that it deems as irrelevant or inappropriate. The Service Provider is not responsible for the content or features of other services in relation to the Service, or acquired through the Service.

 

  1. Availability of the Service

The Service Provider does its best to ensure that the Service is continuously and uninterruptedly available. However, the Service Provider is not responsible for the uninterrupted, timely, or flawless functioning of the Service. The Service Provider is not responsible for the technical errors, interruptions caused by maintenance- or installing works, or information alterations or disappearances caused by them, and for data transfer issues, disruptions, or outages caused by third party actions.

The Service Provider has the right to pause the Service due to alteration or renewal works performed on it, or due to a technical reason related to the Service, or due to maintenance-, installing-, and service works or similar performed on the telecommunications network in case the legislation or other official regulation requires so. The Service Provider will restrict the duration of the interruption to as short a period as possible. If possible, the pause will be announced beforehand. In case the use of a paid Service is obstructed for a reason other than a User dependent reason for a minimum of one (1) day, the Service Provider will extend the usage time of the Service accordingly. However, a prerequisite is, that the User files a complaint of the malfunction to the Service Provider, unless the malfunction in question is a service break announced to the User by the Service Provider beforehand. The User is not entitled to any other compensation for a malfunction caused by a service break.

 

  1. Immaterial Rights

The Service contains copyrighted, trademarked, and other immaterial rights protected material. The entire Service as it is forms a database, and is protected with copyright in accordance with the effective immaterial rights legislation in Finland. The User may utilize the protected material to his/her personal use. The User is not permitted to distribute, publish, copy, make publicly available, or in other ways commercially utilize the material in the Service without a specific, written permission from the author, right-holder, or Service Provider.

The User is not permitted to utilize automated systems (including ”robot-”, ”spider-” ”scraper-” and ”offline reader-” software) to produce sections of the Service, parts of the Service, or contents of the Service, or make them publicly available without a specific, written permission provided by the Service Provider beforehand.

In case copying, publishing, distributing or making publicly available is permitted in accordance with the legislation in special cases, the User must always note the author, or the name of another right-holder. The User is not permitted to supply or distribute material protected by copyright, trademark, or other immaterial right in the Service without a permission from the author or right-holder.

Under this contract, the User is not granted any rights related to the Service, except the right to utilize the Service in accordance with these Terms of Use, and other possible service-specific conditions. The Service Provider has the right to unilaterally alter the terms of this contract by a written notification or through the Service to the User. The alterations step into force immediately. The User accepts the altered terms by using the Service after receiving a notification of the alterations.

 

  1. Material Provided to the Service by the User

The User grants the Service Provider the right to publish the material he/she has submitted to the Service entirely or partially. The Service Provider does not pay a reward or other compensation for the publishing. The User is responsible for the material submitted for publishing not infringing a third party copyright, trademark, or other immaterial right, and not being insulting, infringing this Terms of Use, or otherwise illegal, and that he/she has the right to submit it to the Service Provider for publishing. The Service Provider, however, does not have the right to publish an email sent by the User, or other material clearly not meant for publishing. The User is responsible for all third party compensation- and other claims related to the submitted material. The Service Provider does not adhere to store any material sent or delivered in other ways by the User to the Service in case the material was not subscribed for.

The material uploaded to the Service by the User is only stored for the period of time mentioned in the Service. The Service Provider has the right to delete the submitted material after a reasonable period of time, or within a mentioned period of time after the announce period of time has expired. The User adheres to describe the subject adequately comprehensively and truthfully, when submitting it to the Service. The User must have the right to sell the subjects he/she submits to the Service. The responsibility for the sellable subject and the right to sell it lies on the User. It is forbidden to sell pirated or forged products in the Service.

Transactions within the Service take place between the users, and the Service Provider is not responsible for the transactions taking place within the Service even if the Service Provider was provided with compensation for contributing in the transaction. The Users mutually agree upon the terms of transaction, and the responsibility for realizing those terms lies on the users taking part in the transaction. The Service Provider is not responsible for an unauthorized sale to a third party.

The User is responsible with his/her own expense of all disputes arising from the material he/she has submitted to the Service. The User grants the Service Provider and other companies in the same corporation the right to edit, copy, publish, and distribute material the User has made available in the Service.

 

  1. User’s right to Use the Service

The contract between the User and the Service Provider steps into force as the User accepts this Terms of Use, and thus receiving the right to use the Service from the Service Provider.

The Service Provider grants the User a limited right to use the Service and its contents only in accordance with these Terms of Use, possible special conditions, and separately supplied instructions supplied in the Service. The usage right granted to the User in this Terms of Use is a non-exclusive and personal right, which the Service Provider can terminate any time. The Service Provider also has the right to forbid the User from using the Service, if the User has infringed these Terms of Use, possible special conditions, or separately supplied instructions supplied in the Service, or the legislation, or good etiquette.

The User is aware, that even though there might be an access to services provided by other service providers through the Service provided by the Service Provider, using these service might require a separate registration.

In case the User utilizes a paid Service provided by the Service Provider, he/she must submit the payment announced within the Service. Products or services acquired with or through paid Services are not refundable, or the services do not have a cancellation right, after the delivery of the order is completed in full or initiated electronically based on the order and the consent of the user given when placing the order. The User is informed about the absence of cancellation right when placing the order with a notification in accordance with Section 6, §16 of the Consumer Protection Act.

The User has the right to place a link to his/her own website pointing to the index of the Service. Linking an individual page in commercial or financial purpose is forbidden, even if it is done through a robot search, without a written permission granted by the Service Provider beforehand. The User is not permitted to send or supply other advertising-, marketing-, or announcement material not related to the use of the Service without a consent from the Service Provider. The User is responsible for the items or services he/she offers for sale, loan, rent, etc. in the Service not infringing the legislation or good etiquette, and that he/she has the right to the afore mentioned actions. The User is aware, that a sales offer, which he/she places on the subject to be sold, is always binding.

The Service Provider has the right to prevent the publishing of unauthorized material in the Service, or delete such material from the Service. The User is responsible for all third party compensation- and other claims related to the unauthorized material. The Service Provider has the right to prevent the use of the Service, in case there is a justified reason to believe that the Service is being used to distribute unauthorized material, or in any other way in infringement with the legislation or good etiquette.

 

  1. Username and Password

The User is responsible for storing of his/her username and password, and for not disposing them to any outsiders. The User is responsible for the usage under his/her credentials, and possible costs or payments generated by the use. The user is responsible of notifying the Service Provider of the disappearance or third party acquisition of his/her username or password. The User’s responsibility for the use of the Service under those credentials ends as soon as he/she receives a notice of arrival of the notification from the Service Provider. The user may acquire a new username and password to replace the missing one.

The User may get a new username and password to replace the missing one if he/she wants. The User’s right to use the Service can then be transferred to the new username and password, as well as the remaining credit on a paid Service. The remaining credit will not, however, be returned to the User in cash. The Service Provider has the right to change the User’s username and password, as well as other credentials possibly required in order to use the Service, if technical and other acceptable reasons require so. The Service Provider is not liable to compensate the User for changing the credentials.

 

  1. Personal data

The User must provide the Service Provider with necessary personal- and other data required to use the Service. The User is responsible for informing the Service Provider of changes to that data. The Service Provider has the right to process User’s personal data in accordance with the personal data act and other legislation, and in manner described in the register information for each Service. The User’s information is stored in the Service Provider’s register. The User has a right guaranteed by the law to prohibit his/her personal data to be processed for direct advertising, distance sales, or other direct marketing purposes. The Service Provider has the right to send direct marketing to the User via email in case the User has accepted it when registering, and has not prohibited it at a later date. The Service Provider processes the registered customer’s personal data in accordance with the Privacy Policy and legislation concerning data protection.

The User’s personal data are confidential. However, the Service Provider has the right to submit certain information when conducting transactions, such as buyer information to the subject’s seller, and seller information to the buyer.

 

  1. Data Protection

The User is aware, that network environment and web services are not entirely secure. The User is responsible for the adequate data protection on his/her own information systems. The Service Provider stores all information concerning or sent by the User confidentially. The Service Provider arranges the data protection on its Service in a generally acceptable manner and efficiently, and aims to prevent inappropriate access to its information systems using adequate technical solutions. However, the Service Provider cannot guarantee absolute data protection.

 

  1. Devices, Software, and Connections

The User is solely responsible for the acquisition, functionality, and costs arising from the devices, software, and network connections required to use the Service. They may not cause disruption or other hindrance to the Service or other network users.

 

  1. Indemnity Liability Arising from the Use of the Service

The User is liable to compensate the Service Provider for the damages caused by the use of the Service infringing these Terms of Use, possible service-specific conditions, contract covering the use of Service, or legislation. The Service Provider is not liable for compensating the User for possible damages caused by the use of the Service. The User is responsible for all requirements and costs arising from the use of the Service, such as telephone- and telecommunications costs. The User is obligated, following a request from the Service Provider, to return all such assets that he/she has received in his/her account due to an error, or otherwise wrongfully.

 

  1. Force Majeure

Force Majeure releases the Service Provider of obligations related to the Service, in case it prevents a transaction relative to the Service, or detriments it unreasonably. Fire, earthquake, flood, explosion, strike or other shutdown, authority order, disruption in energy supply, raw material- or accessory shortage, cable- or other telecommunications disruption caused by a third party or other such reason that was not known beforehand, and could not have been reasonably anticipated, are considered as Force Majeure. The Service Provider will announce of a Force Majeure on the Service website right after it has occurred.

 

  1. Altering Terms of Use

This Term of Use apply to all Services maintained by the Service Provider, unless the contract parties agree otherwise in written form. The Service Provider has the right to alter this Term of Use, and possible service-specific conditions. The Service Provider has the right to unilaterally alter the terms of this contract by a written notification or through the Service to the User (with the Terms of Use). The alterations step into force immediately. The User accepts the altered terms by using the Service, and adheres to comply with them.

 

  1. Transferring Rights and Obligations

The User is not permitted to transfer the usage right of the Service, or a possible contract generated within the Service to a third party without a written consent from the Service Provider. The Service Provider has the right to transfer the Service or its maintenance, as well as related responsibilities and obligations, and a possible contract generated within it, to another company belonging in the same corporation. The Service Provider has the right to transfer the contract to a third party.

The contract in accordance with this Terms of Use between the User and the Service Provider is valid indefinitely. Both parties may whenever terminate this contract to end as soon as the other party receives information of the termination. Termination end the User’s right to use the Service. The User is responsible for all responsibilities and obligations of the contract until the termination steps into force.

 

  1. Resolving Disputes

Disputes arising from this Terms of Use, or the service described in this Terms, as well as the contract generated within the Service are aimed to be resolved primarily by negotiations between the contract parties. In case these negotiations fail, the disputes will be resolved in the Helsinki District Court. However, a consumer customer has the right to file a lawsuit against the Service Provider in the court of first instance of his/her domicile. A consumer customer also has the right to ask for a resolution recommendation from the Consumer Disputes Board.

 

  1. Applicable Law

Finnish law is applied on this Terms of Use, and the Service described in these terms, as well as a contract generated within the Service.

 

  1. Cookies

The Service utilizes cookies in order to guarantee a better user experience. The User accepts the storing of the cookies on his/her device by using the Service. The Service Provider has the right to monitor the User’s internet behavior inside the Service, and utilize collected survey results. The surveys are always conducted in such a way, that the results of an individual User are not tracked or published. The Service Provider may utilize the data submitted by the User in marketing co-operation with third parties.

 

  1. Other

The Service Provider will assist the police and other authorities in order to investigate possible abuse by submitting, if necessary, data about a User who has submitted an individual announcement to the extent of data the Service Provider has.
